clause 2.3 states that the employer is obliged to ensure that the employers personal and employer contractor on site: cooperate with contractor effort in providing appropriate opportunities for employer personal, other contractor employed by the employer and personal of any legal constituted public authorities in carrying out their works. contractor shall be entitled to a variation if any instruction causes the contractor to bear unforeseeable cost. services provided for this persons may include using of contractor equipment or temporary works or access arrangement.  take actions to comply with all applicable safety regulations, take care for the safety of all personnel on site and take the necessary measure to keep the site clear from any obstruction to prevent endangering of these personnel. take actions to ensure reasonable steps taken to protect the environment and limit damage, the nuisance of people property resulted from pollution and noise. also, the employer shall ensur

Right of access to the site

Site is the place where the permanent works to be executed and where the plants and materials will be delivered and any other places stated in the contract. The employer shall grant the contractor right to access and possession the site at the time stated in the tender appendix. if under contract the employer required to give the contractor the right of possession of foundation, structures, and plants. this right of access or possession shall be done according to the time and manner stated in specifications. the employer may delay giving the right of access till receiving the performance security. Clause 4.6 stated that contract may be required to submit a document under contract to the engineer before the right of access or possession of site is given. the time and manner of submission of documents shall be as stated in the contract. if no time is given in tender appendix for the right of access to the site. the employer may give the right of access and possession of the site at th

Communications

communications shall be in writing. issuing of approvals, certificates, determination, consents and notices and any kind of communication shall be as following: communications shall be in writing and delivered by hand, email or currier or any approved electronic system to the recipient address that provided in the tender appendix. in the event, the recipient gives notice of address change. communication shall be delivered to the new address. if the recipient didn't give notice of address change when requesting approval. then the communication may be delivered to the address where the request was issued. unreasonable delaying or withholding of approval, consent, certificates, and determination shall not be allowed. in case of issuing a certificate by one part to other party. a copy shall be given to other party. in the event of issuing a certificate by a party to the other party or engineer. a copy shall be delivered to the other party and engineer. construction manag

Interpretation in the contract, the following shall be interpreted as explained: any word indicating gender shall refer to all gender. words indicating singular shall include plural and words indicating plural shall include singular.  provisions including the words: agree, agreement or agreed. this agreement shall be recorded in writing.  written or in writing means typing, handwriting, printing or electronically made. to produce a permanent record. understanding the correct interpretation of contracts words will help in preserving the rights of all parties. therefore a careful reading and interpreting of a contract side by side with conditions of contracts should be done. construction management: concrete construction bridge construction:How to become a bridge engineer

Delayed drawing or instruction and consequence (sub clause 1.9)

The documents of the contract are considered explanatory to each other. the sequence of documents for interpretation purpose shall be as follow the contract agreement: parties will enter contract agreement after receiving the letter of acceptance by 28 days or whatever agreed. the agreement shall be upon form annexed in particular condition. stamp duties or any other charges imposed by law shall be paid by the employer. letter of acceptance: letter of acceptance means the formal acceptance of the letter of tender signed by the employer. letter of tender: letter of tender is a document completed by the contractor and it is including the signed offer to the employer for the tendered work. the particular condition: the condition of contracts set the right and obligation of the contract parties. this includes general conditions which are common for all type of contracts and particular which is special for a contract the general condition  the specification: specification refers t

Retention money

retention money is a percentage retained by the employer from each certified interim payment to make sure that the work executed by contractor complying with project specification and requirement. Amount of retention money will be specified in tender documents. Half of the retention money shall be paid to the contractor after taking over certificate. Daywork

for minor or incidental work such as facing a layer of rock or hard strata unlike what mentioned in tender documents then the engineer may order that work is a variation shall be executed on a daywork basis. before beginning with work the contractor shall provide the engineer with quotations of good, equipments rates etc. For payments. the contractor shall submit an accurate statement on a daily basis including the resources details for previous day work 1.names, designation and times of contractor persons 2.type, number, time for equipment. 3.quantities and type of material and goods used. the engineer may reject the submitted documents if he suspects the contractor is exaggerating the time and number of contracts person, material and equipment. therefore he could ask for more verification. after agreeing and verifying submitted statement the engineer will sign it and return to contract. then the contractor will price and submit the statement. 

nominated subcontractor

performance security

The contract goes through a long sequence of events. the client or his agent will prepare the design for the contract. next step is issuing tendering document such as specification, drawing, and BOQ, etc. then the contractor will be assigned to do the job and the sequence continues until returning the performance security by the client . for simplification, I prepared the following diagram for contract events.

Claim and variation

Claim: when the contractor feels that he will suffer time delay and money loss due to different reasons such as a change in the tender drawing. or change on site condition such as encountering hard rocks while the tender document stating the absence of hard rock. in this case, the contractor will submit a detailed claim within 28 days explaining the reason for the claim and attaching the assertive document. however, if the soil mentioned in the tender is rock and the actual soil is sand. client cant reduces or cuts the cost for this item. construction management: concrete construction bridge construction:How to become a bridge engineer The variation introduced by the client. when the client asks to change some items such as tiles brand. the contractor, in this case, will be paid for cost and given an extension of time as compensation.
